TERMS & CONDITIONS

In the following terms & conditions, “the photographer” shall refer to Shot By KM working under Content Kings Media Inc., including the brand KM Shot It and any related sub-brands. These terms & conditions cannot be varied in any way by the client unless such conditions are expressly agreed by the photographer in writing.

DEPOSITS & PAYMENTS

• ALL studio shoots must be booked at least 72 hours in advance to assure studio availability.
• Location for outdoor/on-location shoots must be provided at least 24 hours in advance.
• A non-refundable deposit of 50% is required to secure your booking. No work will begin until the deposit is received and confirmed.

Deposits may be paid via:

• Invoice through email/SMS
• Paypal - CKmedia484
• Cashapp: $CKMedia8

(MEMO must include name & photoshoot date)

• The remaining balance is due on the day of the shoot, before photography/videography begins.
• If the balance is not paid at the start of the shoot, the photographer reserves the right to cancel the session and retain the deposit.
• Final files will not be delivered until the balance is paid in full.
• Cash payments are accepted and must be recorded. A confirmation receipt will be provided for all cash transactions.
• ALL DEPOSITS ARE NON-REFUNDABLE. ALL PAYMENTS ARE NON-REFUNDABLE once work has commenced, except as stated in the Rescheduling section.

LATE FEES

• Late fees apply after 20 minutes of being late. A $30 late fee will be added to your balance.
• The time you are late will be deducted from your shooting time.
• After 35 minutes late, the photographer reserves the right to cancel your session and retain your deposit/payment.

RESCHEDULING

• If you need to reschedule, contact the photographer at least 48 hours before your session. Rescheduling costs $50.
• If you cancel your session 48 hours or more before the scheduled shoot, your deposit will become a shoot credit valid for 90 days.
• The photographer reserves the right to reschedule a session due to illness, emergency, death in the family, inclement weather, or other unforeseen events. You will be notified as soon as possible and rescheduled at the earliest available date.

CLIENT CANCELLATION

• If the client cancels a project after work has commenced, including pre-production, scouting, editing, or any deliverable creation, the deposit is forfeited in full.
• Any work completed beyond the deposit amount will be invoiced and is due immediately.
• If the client cancels before work has commenced but less than 48 hours before the shoot, the deposit is forfeited unless otherwise agreed in writing.

TURNAROUND & EXPEDITED DELIVERY

• Standard turnaround: 1 week for photos, 2–3 weeks for video unless otherwise agreed.
• Expedited delivery is available upon request before or on the shoot day. Additional fees apply.
• Expedited edits are delivered within 1–3 days. Additional edits requested after delivery will be sent within 7–10 days.
• If CKM fails to meet the agreed expedited deadline, the client may request a partial refund of the expedited fee. This does not apply to standard turnaround timelines.

FILE DELIVERY & USAGE

• Final files will be delivered via online gallery (Pixieset) or direct download link upon receipt of full payment.
• If full payment is not received within 30 days of the invoice date, CKM reserves the right to revoke access to the gallery and/or issue takedown notices for any content posted without authorization.
• The client allows the photographer to display any photograph or video covered by this agreement and to generally promote the business in advertising, NFTs, brochures, magazine articles, websites, sample albums, social media, etc.

BEHIND-THE-SCENES CONTENT

• The client grants Content Kings Media Inc. and its related brands, including KM Shot It, permission to capture and use behind-the-scenes photos and video from the shoot for promotional, educational, and documentary purposes across CKM and KM Shot It platforms.
• The client may opt out of behind-the-scenes content by providing written notice before the shoot date.

MISPLACED/LOST ITEMS

• The photographer is not responsible for any items lost in the studio or during outdoor/location shoots. Reasonable assistance will be provided to locate misplaced items.

LIABILITY

• CKM’s total liability for any claim arising from services provided shall not exceed the total fees paid by the client for the specific project in question.
• CKM is not liable for indirect, special, or consequential damages.
